JEANNA CLEARY ACT

August 14, 2008 the Higher Education Opportunity Act (HEOA) (public Law 110-315) reauthorized and expanded the Higher Education Act of 1965, as amended the HEOA revised the Cleary Act creating additional safety and security related requirements for institutions of higher education, including a $27,500 fine for each unreported event of noncompliance, which can add up when a single violation involves multiple reportable offenses.

The 2008 Amended Cleary Act identifies 12 reportable offenses

that previously were limited to sexual activity against women.

1. Murder
2. Sex offenses both forcible or non-forcible
3. Robbery
4. Aggravated assault
5. Burglary
6. Motor vehicle theft
7. Manslaughter
8. Arson
9. Arrests and or persons not arrested but referred for campus disciplinary action for liquor law violations;
10. Arrests or persons referred for campus disciplinary action for drug-related violations
11. Arrests or persons referred for campus disciplinary action for weapons possession
12. Hate crimes.
